1. General Terms
Consent & Licence to Use Our Site
Consent: By accessing and/or using our Site, you agree to these terms of use and our Privacy Policy (Terms). Please read these Terms carefully and immediately cease using our Site if you do not agree to them.
Variations: We may, at any time and at our discretion, vary these Terms by publishing the varied terms on our Site. We recommend you check our Site regularly to ensure you are aware of our current terms. Materials and information on this Site (Content) are subject to change without notice. We do not undertake to keep our Site up-to-date and we are not liable if any Content is inaccurate or out-of-date.
Licence to use our Site: We grant you a non-exclusive, royalty-free, revocable, worldwide, non-transferable license to use our Site in accordance with these Terms. All other uses are prohibited without our prior written consent.
Prohibited Conduct & Exclusion of Competitors
Prohibited conduct: You must not do or attempt to do anything: that is unlawful; prohibited by any laws applicable to our Site; which we would consider inappropriate; or which might bring us or our Site into disrepute, including (without limitation):
- anything that would constitute a breach of an individual’s privacy (including uploading private or personal information without an individual’s consent) or any other legal rights;
- using our Site to defame, harass, threaten, menace, or offend any person;
- interfering with any user using our Site;
- tampering with or modifying our Site, knowingly transmitting viruses or other disabling features, or damaging or interfering with our Site, including (without limitation) using trojan horses, viruses or piracy or programming routines that may damage or interfere with our Site;
- using our Site to send unsolicited email messages; or
- facilitating or assisting a third party to do any of the above acts.
Exclusion of competitors: You are prohibited from using our Site, including the Content, in any way that competes with our business.
Content & Intellectual Property
Information: The Content is not comprehensive and is for general information purposes only. It does not take into account your specific needs, objectives, or circumstances, and it is not advice. While we use reasonable attempts to ensure the accuracy and completeness of the Content, we make no representation or warranty in relation to it, to the maximum extent permitted by law.
Intellectual Property Rights: Unless otherwise indicated, we own or license all rights, title, and interest (including intellectual property rights) in our Site and all of the Content. Your use of our Site and your use of and access to any Content does not grant or transfer to you any rights, title, or interest in relation to our Site or the Content. You must not:
- copy or use, in whole or in part, any Content;
- reproduce, retransmit, distribute, disseminate, sell, publish, broadcast, or circulate any Content to any third party; or
- breach any intellectual property rights connected with our Site or the Content, including (without limitation) altering or modifying any of the Content, causing any of the Content to be framed or embedded in another website or platform, or creating derivative works from the Content.
User Content
User Content: You may be permitted to post, upload, publish, submit or transmit relevant information and content (User Content) on our Site. We claim no ownership of the intellectual property rights in User Content you provide to the Site. Your profile and materials uploaded remain yours. However, by setting your pages to be shared publicly or making available any User Content on or through our Site, you agree to allow others to view and share your User Content and you grant to us a worldwide, irrevocable, perpetual, non-exclusive, transferable, royalty-free license to use the User Content, with the right to use, view, copy, adapt, modify, communicate, publicly display, publicly perform, transmit, stream, broadcast, access such User Content on, through or by means of our Site. You agree that you are solely responsible for all User Content that you make available on or through our Site. You represent and warrant that:
- you are either the sole and exclusive owner of all User Content or you have all rights, licenses, consents, and releases that are necessary to grant to us the rights in such User Content (as contemplated by these Terms); and
- neither the User Content nor the posting, uploading, publication, submission, or transmission of the User Content or our use of the User Content on, through, or by means of our Site will infringe, misappropriate or violate a third party’s intellectual property rights, or rights of publicity or privacy, or result in the violation of any applicable law or regulation.
We do not endorse or approve, and are not responsible for, any User Content. We may, at any time (at our sole discretion), remove any User Content.
2. Payment, Billing & Refunds
Payment: Yaeris reserves the right to offer additional payment methods and/or remove existing payment methods at any time at its sole discretion. If you choose to pay using an online payment method, the payment shall be processed by our third-party payment service provider(s). With your consent, your credit card/payment information will be stored with our third-party payment service provider(s) for a future subscriptions. Yaeris does not store your credit card or payment information. You must ensure that you have sufficient funds on your credit and debit card to fulfill payment of an order. Yaeris only provide the ways of payment to Consumer via our payment platform. Yaeris does not take responsibility for payments made on our Platforms to Merchant. The consumer must deal directly with Merchant for that matter.
Refund for Consumer: In the matter of dispute between Yaeris and Consumer on refund and cancellation, Yaeris doesn't provide refund policy because Yaeris is selling advertising service. Once service/product is used, it is considered sold.
Cancellation and refund policy: Credit is defined as a token purchase to perform a send to a mobile number provided by a Consumer with Yaeris software. Yaeris doesn't provide any refund policy for Yaeris Services because it is selling advertising product/service.
In the event of canceling your account:
- Consumers have to finish utilizing all the credits in the Consumer’s portal before deleting his/her account. Yaeris doesn’t refund for any negligence made by Consumer.
- A refund is not available because it is selling advertising product/service.
3. Messaging Services (Blasting)
Service Overview & Guaranteed Result
Message Blasting Service Provider
- On or from the Effective Date and during the Term, the Message Blasting Service Provider agrees to provide the Services in accordance with the terms of this Agreement.
- The Customer agrees the Message Blasting Service Provider owns or holds the applicable licenses to all Intellectual Property Rights including but not limited to copyright in the Message Blasting Service Provider and any documentation provided with the Services by the Message Blasting Service Provider to the Customer including any Customer configuration documentation.
- Message Blasting Service Provider reserves the right to change or remove features of the Message Blasting Service from time to time. Where there is any material alteration to the Message Blasting Service in accordance with this clause, the Message Blasting Service Provider will provide the Customer with 1 Business Days’ notice and the Customer agrees that any material alteration is at the Message Blasting Service Provider’s discretion.
- The Message Blasting Service Provider reserves the right to refuse any request in relation to the Services that it deems inappropriate, unreasonable, or illegal.
Yaeris Service
- Yaeris provides a platform and service to assist any individual and companies to send out large quantity of messages in 24 hours without having to worry about their own WhatsApp number getting blocked by WhatsApp.
- Our product does not in any way represents an extension of the official WhatsApp, Telegram, and LINE messaging app.
- Yaeris reverses the right to change its business operation for the best interest of the company.
- Yaeris may or may not choose to announce any changes made by company.
Yaeris Guaranteed Result
- Yaeris does not guarantee results after using our services due to external factors which may/might cause the result to skew away from the intended target. The reasons could be:
- WhatsApp/Telegram/LINE/Zalo/Signal/iMessage server-side
- SIM card got banned/blocked
- The recipient has set his own privacy in their own app
- Exposed to the risk of previous SIM card owner retrieving his SIM card number which will then affect the continuity of the SIM card which you are planning to use for blasting purposes.
- Negligence caused by our SIM card supplier who fails to upload profile pictures into some of your dedicated SIM cards.
- Other factors
- Yaeris provides the best effort in delivering all Consumers’ campaigns.
- Please directly talk to our support team if you have any complaints about your purchases.
General Rules for All Channels
All the risks associated on using our blasting service (which includes WhatsApp Blasting, Telegram Blasting, iMessage Blasting, SMS Blasting, Signal Blasting, LINE Blasting) are stated below. Please read and fully understand it before making any purchasing decision.
- We do not 100% guarantee the blasting speed. All campaigns will be completed in 24 hours. You will not be able to choose which exact time to start sending out your message.
- We do not 100% guarantee on receiving rate. Our job is to send out your message. Whether or not your recipients receive or read, we do not know and have this information.
- We do not have a refund policy. Client not receiving the message may be caused by WhatsApp/Telegram/iMessage server-side error, SIM card got banned, the recipient has set his own privacy in their own app & other factors.
- The credits for all completed campaigns will be refunded back to you within 24 hours after your campaign has been completed
- This is 1-way blasting/communication. There is no way to reply back to your interested audience.
- You are allowed to submit/create 3 campaigns per day (max). 1 campaign can contains unlimited numbers in it (depend on remaining credit left in your wallet). Any additional campaign created will be rejected. This is to protect our 24-hour campaign fulfillment SLA level to our customers.
- Campaign spamming is prohibited. If our QA team finds out that you submit more than 3 campaigns per day, your account will be suspended with no refund given.
- Our delivery rate defines as percentage of messages sent out from our server. It doesn't mean percentage of messages received by your recipients.
- We are not able to send to China, Hong Kong & Taiwan phone number.
- Campaign duplication is prohibited & will result in account suspension with no refund. Campaign duplication occurs when a user submits multiple campaigns with the same content messages, same attachment & same list of phone numbers per day.
- We do not guarantee double ticks or blue ticks for your WhatsApp deliverables. We only guarantee 1 tick or 0 tick which will be indicated in our report.
- Our report only shows you the message that has been successfully sent out from our server. Not the number of messages received by your customer. In other words, we can only let you know which number is 1 tick and which number has 0 tick. We are not able to track double tick or blue tick. We are not using any API to blast your message. There is no transparency here.
- We will deduct the credit as long as we have sent out your messages from our server. In other words, as long as we achieve 1 tick, the credit will be deducted from your account.
- The link that you insert in your content may be unclickable due to WhatsApp security measures against spamming. Hence, you need to guide your audience to activate the link, he/she needs to reply back the message.
- The profile picture that you inserted during creating the campaign will not stay there forever because we are sharing our WhatsApp accounts with all of our customers. Other customers also have their profile picture to upload which will cause your profile picture to be replaced by theirs once your campaign has been completed.
iMessage
- Our report only shows you the message that has been successfully sent out from our server. Not the number of messages received by your customer. We are not able to track which recipients receive your message since we are not using any API to blast your message. There is no transparency here.
- We will deduct the credit as long as we have sent out your messages from our server.
- The link that you insert in your content may be removed by Apple if Apple deems your link as malicious. We are not responsible for that and not going to refund any credit if this situation happens. We only refund credit to you when we detect the number that you upload does not have an iMessage account. That is the only reason we do that.
- The profile picture that you inserted during creating the campaign will not stay there forever because we are sharing our iMessage accounts with all of our customers. Other customers also have their profile picture to upload which will cause your profile picture to be replaced by theirs once your campaign has been completed.
- If our system detects one of the phone numbers you upload doesn't have imessage account, our system will send out sms instead. If your message contains any link or illegal contents, the sms will not send out due to government regulation. In this case, your credit will still be deducted.
Telegram
- Our report only shows you the message that has been successfully sent out from our server. Not the number of messages received by your customer. We are not able to track which recipients receive your message since we are not using any API to blast your message. There is no transparency here.
- We will deduct the credit as long as we have sent out your messages from our server.
- The profile picture that you inserted during creating the campaign will not stay there forever because we are sharing our Telegram accounts with all of our customers. Other customers also have their profile picture to upload which will cause your profile picture to be replaced by theirs once your campaign has been completed.
- Your message will not be received by your contacts if your recipients decide to set the phone number privacy from Everybody to Nobody. In this case, the credit will still be deducted.
SMS
- Our report only shows you the message that has been successfully sent out from our server. Not the number of messages received by your customer. We are not able to track which recipients receive your message since we are not using any API to blast your message. There is no transparency here.
- We will deduct the credit as long as we have sent out your messages from our server.
- Since we are using Malaysia telco network to send out your SMS, your sms delivery is closely tight to these telco network's capability and their infrastructure. We will not be responsible if your recipients fail to receive sms.
- You are not able to insert links into your content due to government regulation.
- All submitted campaigns will take 24 hours to complete. You are not able to choose/schedule time to send out your sms.
- Illegal content is not allowed such as online gambling, drug and etc.
Advise performing to insert your own number in the list that you want to blast out. If your number is received, you can only safely assume that all the numbers you have uploaded in the campaign are received as well. Even though your number didn't receive the message, the credit will still be deducted from your account as we have used up our sim card quota to send out messages. In this scenario, we are not responsible for ensuring you receive your message on your end. Just like you park your call in shopping mall, the mall management tells you, Park at your own risk. We also tell you the same thing now, Blast at your own risk.

4. Software Terms
The following applies to Yaeris's self-serve software products generally (WhatsApp Blaster Software, WABA MultiChat Software, and other software you operate yourself). See Section 5 below for terms specific to MCP Server, Radar/Crawl API, and Launchpad.
- If there is any technical error, we will take 24 - 48 hours to fix it.
- Our server will service your campaign on best effort basis. The traffic within the server is shared across all of our customers. Your submitted campaign will usually be on queue.
- Any technical glitch derives from the software will take 24 - 48 hours to fix it. If the issue is complicated, it will take more than 48 hours.
- We are not responsible if your WhatsApp account gets blocked. In this case, we are just a software provider.
- We are not responsible in achieving your expectation/assumption. You are the one who is responsible at the end of the day.
- We do not have refund policy.
5. Product-Specific Terms
The following sections apply in addition to the General Terms above, specific to the named Yaeris product you use. Where a product-specific section conflicts with the General Terms on a matter it covers, the product-specific section governs for that product.
Yaeris MCP Server
- AI-Agent Execution Authorization
- When you connect an AI model (Claude, or any other MCP-compatible model or client) to your Yaeris MCP Server account, you are explicitly authorizing that AI to take real actions on your connected accounts based on natural-language instructions — not just to read or summarise data. This includes actions such as publishing or deleting content, modifying store products, creating or editing ad campaigns, and running scripts against a live browser session, depending on which tools you have enabled.
- You are solely responsible for reviewing what you ask an AI to do, and for reviewing the actions it takes on your behalf, before and after they happen. An AI model can misinterpret an ambiguous or incomplete instruction and take an action you did not intend.
- Yaeris is not liable for any loss, damage, or cost arising from an AI model's interpretation of your instructions, including a misinterpretation that leads to unintended changes, deletions, or spend on a connected third-party platform.
- Where a tool supports a dry-run or preview mode, or requires manual approval before executing, we recommend you use it — but the decision to enable direct execution instead is yours, and responsibility for the outcome follows that decision.
- Third-Party Credential Storage & Scope
- To connect a third-party platform (including WordPress, Google Ads, Google Analytics, Meta, Shopify, WooCommerce, and other supported integrations), you provide Yaeris with credentials such as an API key, OAuth token, or application password for that platform. These credentials are encrypted at rest and are only decrypted at the moment a tool call needs to use them.
- You can disconnect or revoke any connected platform at any time from your account dashboard. Disconnecting removes Yaeris's ability to call tools against that platform going forward; it does not undo actions already taken before disconnection.
- Yaeris is not a party to your relationship or terms of service with any third-party platform you connect. If you connect WordPress, you remain bound by WordPress.org's or your hosting provider's own terms; if you connect Google Ads, you remain bound by Google's own Ads policies and terms; and so on for every other connected platform. Yaeris is not responsible for, and does not warrant, the availability, behaviour, or terms of any third-party platform.
- You must have the legal right to grant Yaeris access to any account or platform you connect. Connecting an account you do not have authority over is a breach of these Terms.
- Write-Access Tool Acknowledgment
- Many MCP Server tools are destructive or side-effecting by design — meaning they can modify, delete, or spend real data, content, or money on a connected platform. Examples include tools that delete or overwrite content, modify search-and-replace content site-wide, create or edit paid ad campaigns, update live store products, or execute arbitrary code against a live browser session.
- By enabling and using these tools, you acknowledge that they can make real, consequential changes to your connected accounts, and that you are responsible for verifying the result of any action before and after it runs.
- Where reasonably practical, Yaeris applies conservative safety defaults — for example, a delete-type tool defaulting to moving content to trash rather than permanent deletion, or a bulk content-modification tool defaulting to a dry-run/preview mode that must be explicitly overridden to write changes. These defaults reduce risk but do not eliminate it, and do not shift responsibility for the outcome away from you, particularly for tools that spend real money (such as advertising tools) or that you have explicitly configured to bypass a safety default or approval step.
- Credit & Billing Terms
- MCP Server usage is billed on a credit basis, purchased through our payment processor (Stripe). Each tool call consumes a set number of credits, disclosed on the relevant tool's listing before you enable it.
- If a tool call fails or errors out before completing its intended action, we do not charge credits for that failed call where the failure is on our side (e.g. a system error). Where a call partially completes against a third-party platform before erroring, credits already consumed by that partial execution are not refunded, since the underlying cost to Yaeris (and, where applicable, to the third-party platform) has already been incurred.
- If you have auto-recharge enabled and your payment method fails, we will notify you and your account may be limited or paused until a successful payment is made. Yaeris is not liable for any consequence of a paused account due to a failed payment, including missed automation runs.
- Unused credits do not expire while your account remains active in good standing. We reserve the right to introduce or change an expiry or dormancy policy in the future, with reasonable prior notice published on our Site.
- Data Retention & Deletion
- When you cancel your account, your stored third-party credentials are deleted from our systems within 30 days. Usage history and audit logs may be retained for a longer period as required for accounting, fraud-prevention, or legal purposes, consistent with our Privacy Policy.
- You may request earlier deletion of your stored credentials by contacting support@yaeris.com; we will action such requests as soon as reasonably practical.
- Service Availability — No Uptime Guarantee
- The MCP Server is provided on a best-effort basis. We do not publish or guarantee a formal uptime Service Level Agreement (SLA). The service runs on infrastructure that is not yet built to redundant, enterprise-grade high-availability standards, and may experience downtime, including for maintenance, incidents, or factors outside our control.
- If your use case requires a contractual uptime guarantee, contact us directly to discuss what may be possible for your situation before relying on the MCP Server for a use case where downtime would cause you material harm.
- Rate Limits & Fair Use
- API and tool-call requests are rate-limited (currently 60 requests per minute per IP address on the MCP endpoint) to protect service stability for all customers. This limit may change without prior notice.
- Deliberately working around, or attempting to work around, this rate limit — including distributing requests across multiple accounts or IPs to evade it — is prohibited.
- Using any tool for a purpose other than its intended function is prohibited and treated as a Terms violation, not merely a technical limit to route around. Examples include using a browser-automation tool (such as one that executes arbitrary JavaScript against a live page) to run unrelated compute workloads (e.g. cryptocurrency mining) inside our sandboxed environment, or using a third-party data/SEO tool to scrape a competitor's data at a scale beyond genuine, individual research use.
- Security Incident Disclosure
- We take reasonable technical measures to protect stored credentials and account data, including encryption at rest and access controls. No system is guaranteed to be free of security incidents.
- If we discover that your stored credentials or account data have been exposed or compromised, we will notify you within a reasonable timeframe once we have enough information to do so responsibly, and will describe what happened and what we are doing about it, consistent with applicable law in the relevant jurisdiction.
- Acceptable Use
- You must not use the MCP Server, or any connected account, for anything illegal.
- You must not use the MCP Server's crawling, browser-automation, or similar tools to scrape, attack, or otherwise interfere with a third-party site or system without authorization to do so.
- You must not resell, sublicense, or otherwise provide third parties with access to the MCP Server under your own account or API credentials without our prior written consent.
- Intellectual Property & AI-Generated Output
- You own your own content, data, and connected-platform accounts. Yaeris owns the MCP Server platform, its tools, and underlying software.
- Where a tool generates output on your behalf (for example, a drafted blog post, ad copy, or other AI-generated content), that output belongs to you, subject to any separate terms imposed by the underlying AI model provider or third-party platform it is published to. You are responsible for reviewing AI-generated output before publishing or acting on it, including for accuracy and for any third-party rights it may implicate.
- Limitation of Liability
- To the maximum extent permitted by law, Yaeris's total liability to you arising out of or relating to the MCP Server is limited to the total fees you paid to Yaeris for the MCP Server in the 12 months preceding the event giving rise to the claim.
- To the maximum extent permitted by law, Yaeris is not liable for any indirect, incidental, special, or consequential damages, including lost profits, lost data, or lost business opportunity, arising from or relating to an action taken by an AI model connected to your account — whether that action was correctly instructed and simply had an unwanted outcome, or was based on a misinterpretation of your instruction as described in Section 1 above.
Radar & Radar Crawl API
- General
- You are solely responsible for making sure your use of Crawler, SERP Lookup, Email Outreach, and AI Call Outreach complies with all laws that apply to you and your recipients — data protection law (e.g. Malaysia's PDPA, GDPR if you target the EU/UK), anti-spam law (CAN-SPAM, CASL), and telemarketing/robocall law (TCPA and equivalents) if you target the US or other regulated markets.
- For Email Outreach and AI Call Outreach, Radar is not the sender or caller of record — you connect and send through your own Smartlead, Instantly, MailRush, Bland.ai, or Retell account. Radar does not verify recipient consent, opt-in status, or Do-Not-Call registry status; that responsibility is entirely yours.
- Crawler & SERP Lookup — Acceptable Use
- The Crawler respects robots.txt and rate-limits requests, but you still may not use it against a site whose own Terms of Service prohibit scraping, or to collect data you have no lawful basis to collect.
- No crawling for harassment, fraud, spam-list building, or wholesale copying of copyrighted content for resale.
- Extracted contact data (name/phone/email) may be outdated or wrong — Radar makes no accuracy guarantee and isn't liable for decisions made on it.
- SERP Lookup is for your own ranking research/tracking, not for manipulating search results or violating Google's own terms.
- Email Outreach — Acceptable Use
- You must have a lawful basis (consent, or legitimate interest where your jurisdiction allows it) for every recipient before uploading them into a campaign.
- No spam, phishing, deceptive subject lines, adult content, or illegal goods/services/financial-scam content.
- You must honor unsubscribe/opt-out requests promptly through your connected provider.
- Radar doesn't guarantee deliverability, open rates, or reply rates — inbox placement depends on your own domain reputation and connected ESP account, not on Radar.
- AI Call Outreach — Acceptable Use
- Same consent requirement as above, plus: Do-Not-Call registry compliance, permitted calling hours, and required opt-out/identification during the call, per the destination country's rules.
- You are responsible for any call-recording consent/disclosure law that applies (e.g. two-party-consent jurisdictions) — Radar stores what the provider returns, it doesn't manage recording consent for you.
- No auto-dialing or prerecorded calls to numbers without a legitimate relationship or valid consent.
- Credits & Billing
- Crawler: charged per page crawled once the job finishes (plus a surcharge if HTML/Markdown output is requested) — no refund for a completed job, even if a target site blocked the crawl or results were incomplete.
- SERP Lookup: charged immediately, based on real per-lookup cost.
- Email Outreach / AI Call Outreach: the actual send/call cost is paid directly to your own connected provider account, not to Radar.
- Radar delivers the crawl/lookup/send/call attempt — not a guaranteed outcome (a reply, a pickup, a ranking result).
- Data Handling
- Uploaded contact lists and crawled data are stored to run your campaigns and are not sold or shared beyond what's needed to execute them (e.g. passing recipients to your connected ESP). You're responsible for your own data-retention obligations toward your contacts.
- Suspension
- Radar may suspend Outreach access for illegal scraping, confirmed spam/TCPA/DNC violations, or abuse reports from a connected provider, without refunding already-used credits.
- Not Legal Advice
- This section describes acceptable use of Radar's own platform — it isn't legal advice on privacy or telemarketing law in your jurisdiction. Get your own legal review before running cross-border campaigns.
Launchpad
- Service Description
- Launchpad is a hosting platform for Strapi projects. At this stage, Launchpad supports Strapi only, and runs from a single region (Singapore), serving Southeast Asia. Support for additional CMS platforms or regions, if introduced, will be announced on our Site.
- Bring Your Own Database (BYODB)
- Launchpad never stores, accesses, or backs up your CMS database or content. Your database lives entirely in the external Postgres, MySQL, or MongoDB provider you connect (such as Supabase, Neon, PlanetScale, or your own server) — Launchpad only holds the connection string you provide, encrypted at rest, in order to let your Strapi instance connect to it.
- By using Launchpad, you acknowledge and agree that responsibility for your database's availability, backups, security, and data retention rests entirely with you and your chosen database provider — not with Yaeris. Yaeris is not a party to your relationship or terms of service with that database provider.
- If your database becomes unavailable, is misconfigured, or is lost due to your own provider, your own account settings, or your own actions, Yaeris is not responsible for any resulting data loss or downtime.
- Plans & Billing
- Launchpad is offered on Personal, Pro, and Team/Agency plans, each with its own included usage credit and metered overage beyond that credit, billed through our payment processor (Stripe). Current pricing and plan details are published on the Launchpad page of our Site and may change from time to time.
- If you downgrade or cancel a paid plan, your existing projects continue running under the limits of the Personal (free) tier rather than being immediately deleted. This is our current practice, not a permanent guarantee — we reserve the right to introduce a defined retention window after downgrade or cancellation, after which an inactive project's deployment (not your external database, which we never hold) may be removed, with reasonable prior notice published on our Site before any such policy takes effect.
- The Personal (free) tier is subject to idle hibernation — a project with no traffic for a period (currently 30 minutes) is hibernated and will need to wake on the next request, which may introduce a brief delay. This does not apply to paid plans in the same way; see the Launchpad pricing page for current tier-specific behaviour.
- Acceptable Use
- You must not use Launchpad to host or deploy illegal content.
- You must not abuse shared worker resources — including running cryptocurrency mining, denial-of-service tooling, or any workload unrelated to operating your Strapi project — on Launchpad's infrastructure.
- Launchpad's GitHub integration is a shared integration governed by GitHub's own Terms of Service; you must comply with GitHub's terms in addition to ours when connecting a repository.
- Service Availability — No Uptime Guarantee
- Launchpad is provided on a best-effort basis. We do not publish or guarantee a formal uptime Service Level Agreement (SLA). The service currently runs from a single worker region without formal high-availability failover, and the Personal tier hibernates idle projects as described above. If your use case requires a contractual uptime guarantee, contact us directly to discuss what may be possible before relying on Launchpad for a use case where downtime would cause you material harm.
- Suspension & Termination
- We may suspend or terminate your Launchpad account or a specific project for breach of these Terms, non-payment, or activity that we reasonably believe poses a security or abuse risk to Launchpad's shared infrastructure or other customers, with notice where reasonably practical.
- Intellectual Property
- You own your own code, content, and the database you connect. Yaeris owns the Launchpad platform and its underlying software and infrastructure tooling.
- Limitation of Liability
- To the maximum extent permitted by law, Yaeris's total liability to you arising out of or relating to Launchpad is limited to the total fees you paid to Yaeris for Launchpad in the 12 months preceding the event giving rise to the claim.
- To the maximum extent permitted by law, Yaeris is not liable for any indirect, incidental, special, or consequential damages arising from or relating to your use of Launchpad, including any loss of data held in a database you connect under the Bring Your Own Database model described in Section 2 above.
- Governing Law
- This section is governed by the same governing law and jurisdiction clause set out at the end of these Terms.
6. General Legal
Discontinuance: We may, at any time and without notice to you, discontinue our Site, in whole or in part. We may also exclude any person from using our Site, at any time and at our sole discretion. We are not responsible for any liability you may suffer arising from or in connection with any such discontinuance or exclusion.
Indemnity: To the maximum extent permitted by law, you must indemnify us, and hold us harmless, against any Liability suffered or incurred by us arising from or in connection with your use of our Site or any breach of these Terms or any applicable laws by you. This indemnity is a continuing obligation, independent from the other obligations under these Terms, and continues after these Terms end. It is not necessary for us to suffer or incur any Liability before enforcing a right of indemnity under these Terms.
Termination: These Terms are effective until terminated by us, which we may do at any time and without notice to you. In the event of termination, all restrictions imposed on you by these Terms and limitations of liability set out in these Terms will survive.
Governing Law: These Terms shall be construed in accordance with the laws of Malaysia. The parties hereby submit to the exclusive jurisdiction of the Federal courts sitting in Seremban, Malaysia. The parties (a) agree that all claims in respect of any such suit, action, or proceeding may be heard and determined by any such court, (b) waive to the fullest extent permitted by applicable law, any immunity from the jurisdiction of any such court or from any legal process, (c) agree not to commence any such suit, action or proceeding other than in such courts, and (d) waive, to the fullest extent permitted by applicable law, any claim that any such suit, action or proceeding is brought in an inconvenient forum.
